§ 90.03. AUCTION OF ABANDONED VEHICLES.

If an abandoned motor vehicle has not been reclaimed pursuant to the notice procedures provided for in Section 90.05, the Police Department may sell the abandoned motor vehicle at a public auction upon proper notice pursuant to Texas Transportation Code Sections 683.012 through 683.015 or may use or transfer the abandoned motor vehicle pursuant to Texas Transportation Code Section 683.016. Proceeds of the sale shall be applied first to the expenses of the sale, towing, preservation, storage, publication, and any other reasonable incidental costs. Any remainder of the proceed shall be held for the owner or lienholder for 90 days and then shall be deposited in a special fund which shall remain available for the payment of expenses of storage and sale of other abandoned motor vehicles acquired under the provisions of this chapter.
