§ 113.01. DEFINITIONS.

  • For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

    AUTHORIZED AGENT OR EMPLOYEE. The employees of the city.

    CITY The City of Kirby.

    FOOD EMPLOYEE. An employee, or food or beverage handler, or any person, including any cook, cook's helper, waiter, waitress, dishwasher, bartender, barmaid, busboy or other person, whether or not the owner of the establishment in which the activity is performed employs or pays any compensation to such person to perform such activity, who engages in the delivery, storing, preparation, dispensing or serving of food or beverages as defined herein, for human consumption; or who engages in the handling, use, cleaning or preparation for use of any pots, pans, grills, skillets, plates, trays, eating utensils or similar wares and on or with such food or beverage is prepared, dispensed or served.

    FOOD ESTABLISHMENT. A food service establishment, a retail food store, a mobile food unit, and/or a roadside food vendor.

    HEALTH INSPECTOR. The City Health Inspector or his or her authorized representative.

    STATE LAW. The provisions of Tex. Health and Safety Code §§ 341.001 through 341.067, 341.091, and 341.092 as amended.

    STATE RULES. The State Rules found in 25 Texas Administrative Code Sections 228.1—228.278.

    TEMPORARY FOOD ESTABLISHMENT. A food establishment that operates for a period of no more than 14 consecutive days in conjunction with a single event or celebration.
